CANCELLATION POLICY

IMPORTANT: When you register for a Track Day, you are paying for and taking up one ‘place’ on the track. Here are the details for cancellations or transfers of a Higgy’s Track Day:

1. Cancellations or Transfers of a Higgy’s Track Day

A. Cancellation

1.1 – 60 days or more before the Track Day, we charge a $50.00 administration fee and we’ll refund the balance for the cancelled day, OR, we change you to a later date in the same season, subject to space availability, and you pay a $50.00 administration fee. Just to be extra clear on this: if no spots are available later in the season, that means we can’t place you in a track date later in the season, and you’ve effectively lost your spot. Best thing to do is to find someone to sell/transfer the ticket.

1.2 – Less than 60 days before the Track Day, Cancellations are Not Permitted and there will be no refund.   You are, however, permitted to transfer the spot to another rider, provided they also agree to both VIMC and HOTT’s Full Term’s and Conditions. It is the responsibility of the transferring customer to obtain both payment from the transferee and to also obtain confirmation in writing (such as email) that the transferee agrees to both the VIMC and HOTT Terms and Conditions.

B. If a customer does not attend their scheduled Track Day there will be no refund.

Please be advised, HOTT administration will not break this policy, so please do not ask as there are no exceptions to the rule.

C. Transfers

All transfers must be approved in writing by HOTT management.

HEALTH AND MEDICAL DISCLOSURE

1.   Pandemic/COVID 19 – If the track is closed due to a Pandemic such as Covid-19 and Higgy’s is unable to hold one or several events then that portion of the Track Day Pass or Pack will be refunded.

2.   Customers MUST notify Higgy’s On The Track Ltd. if they suffer from any physical limitations, physical impairment, cognitive impairment, or are taking any medication that could adversely affect their physical or cognitive ability to operate the motorcycle in a safe manner.  If you do not wish to disclose medical details on your application form, we strongly urge you to have a private written (email) discussion with Mark Higginbottom, Owner, prior to commencing riding. Being aware of physical or mental conditions allows Higgy’s staff to make some adjustments to your riding requirements, as well as maintaining the safest possible riding experience for you and other Higgy’s customers.

3.   HOTT does not provide Medical Insurance.   All riders are responsible for providing their own personal medical insurance coverage (Note- this would likely be less of a concern for Canadian citizens)

REQUIREMENTS:  WAIVER   /   LIABILITY

All riders are Required to carefully read and, if agreed, accept the HOTT Terms and Conditions.   There is also a Liability Waiver/Release provided by VIMC that you Must sign at the start of each track day.   This document is found at the VIMC Front Desk / Reception and staff will have a new copy for you to read and if accepted, sign, on each morning of each event.

Generally speaking the waiver states that participation in Track Days is dangerous and that you will not hold HOTT or VIMC, their volunteers and staff, or any participants, riders or attendees liable for injury, damages, etc.    You will Not be allowed on track until we receive your signed Waiver.    Intentionally dodging, or avoiding, signing the liability waiver does not excuse you from the HOTT/VIMC Terms and Conditions that cover the event.

All riders are expected to ride in a safe, courteous, and careful (“ride within your limits”) manner on track, as well in the paddock, parking lot, and the facility in general.

All riders MUST attend the mandatory morning riders meeting. Non-attendees will not be allowed on the track until they have sufficiently reviewed all aspects of missed riders’ meeting.

  • Riding a motorcycle on track is dangerous.  Serious Injury and even death is possible at a motorcycle track day.  All riders who ride and or attend a HOTT Track Day do so entirely at their own risk and responsibility.
  • All riders are responsible for their own personal medical insurance coverage. HOTT does not provide medical insurance. Reckless riding of any kind is subject to ejection from the event.
  • Crashing– DON’T.  If you do crash, the accident will be evaluated and if it is determined that it was caused by reckless or unsafe riding, it will result in ejection from the day’s event. If we feel it was just a simple incident and the medical staff clears you to be able to continue – and your bike passes a post-crash mechanical inspection – we will get you back in to your next session.
  • 15 vehicles are allowed on track at any given time/session, plus two (2) Control Riders.
  • Any accidents, incidents, injuries, or damages having occurred must be promptly reported to Higgy’s staff.
  • It is incumbent on the rider that they arrive at a HOTT event with a motorcycle that is in excellent mechanical condition and is ready for the heavy duty use that is part of a motorcycle track day. All motorcycles must be inspected by tech inspection prior to (re-)entry to the track.  The HOTT tech inspection is not a formal inspection;  each rider is responsible for the careful and complete preparation of their motorcycle(s) to withstand the severe demands of continued performance riding at the track. The HOTT technical inspection is in no way a confirmation that the bike is ready for track day use. Indeed, the HOTT inspection is merely a brief look at a bike to check that the very basic functions of the bike appear to be in good working order; we are Not confirming the bike is actually in good working order. That is Your responsibility.
  • Helmets must be less than 10 years old from the date of manufacture. Helmets must be DOT -approved. Helmets must be closed face. Modular (“flip-up”) helmets, if DOT-approved, are OK.   Dirt bike helmets, if DOT-approved, are OK.
  • Interruptions that occur during a HOTT track day caused by breaks, weather conditions, traffic, emissions, or safety, shall not be credited.
  • Falsification or misuse of tech stickers (group jumping) will result in ejection from day’s event.   No Refunds.
  • We have very specific requirements for rider safety gear and motorcycles. We cover this in detail under General Information (Riding Gear Requirements).
  • If an unregistered rider is found riding a registered rider’s bike, both the registered and unregistered riders will be ejected from the day’s event and banned from HOTT for the remainder of the year.  No Refunds.
  • Alcohol consumption, Cannabis consumption (of any kind), and illegal substances are strictly prohibited at any HOTT event.  Having any medical issues that require to use such substances does not give you permission to participate.
  • HOTT reserves the right to refuse admission to any individual at any time before or during the event.
  • Riders ejected from any HOTT event forfeit all payments/credits for that day.
  • Severability Clause:  Should one or more provisions of this agreement be or become invalid or void, this shall not affect the validity of the remaining provisions.  The invalid provision shall be replaced by such valid provision as shall come closest, in factual and economic terms, to what the parties had intended.
  • Any amendments or additions to this agreement shall require written form.  Oral side agreements shall be valid only if confirmed in writing.   HOTT’s general terms and conditions shall be part of this agreement only if and to the extent that this was explicitly agreed to in writing.
